Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of PingNG ("the Service"), a network monitoring platform operated by Maiko BOSSUYT, based in France ("we", "us", "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Account Registration

  • You must provide a valid email address to register.
  • You are responsible for maintaining the security of your account.
  • One person or organization may not maintain more than one free account.
  • You must be at least 16 years old to use the Service.

3. Subscriptions & Billing

  • The Service offers free and paid subscription plans.
  • Paid subscriptions are billed monthly or annually via LemonSqueezy (our Merchant of Record). All prices are in EUR and include applicable taxes.
  • You can upgrade, downgrade, or cancel your subscription at any time.
  • Cancellation takes effect at the end of the current billing period. No prorated refunds are issued.
  • We reserve the right to change pricing with 30 days' advance notice.

4. Acceptable Use

You agree not to:

  • Use the Service to monitor targets you do not own or have authorization to monitor.
  • Use the Service as a tool for denial-of-service attacks or network abuse.
  • Attempt to circumvent plan limits, rate limits, or security measures.
  • Reverse-engineer, decompile, or disassemble the Service.
  • Share account credentials or allow unauthorized access.
  • Use the Service for any illegal activity.

Violation of these terms may result in immediate account termination without refund.

5. Service Availability

We strive for high availability but do not guarantee 100% uptime. Scheduled maintenance windows will be communicated in advance when possible.

Support response times vary by plan:

  • Free: Community support (best effort)
  • Pro: Email support, 48h response time
  • Business: Priority support, 24h response time
  • Enterprise: Dedicated support, 4h response time

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. We process your data in accordance with the GDPR and applicable EU data protection laws.

7. Intellectual Property

PingNG and all associated trademarks, logos, and content are the property of Maiko BOSSUYT. All rights reserved. The Service software is proprietary and may not be copied, modified, or distributed without explicit written permission.

You retain ownership of all data you upload to the Service. We do not claim any intellectual property rights over your monitoring data.

8. Limitation of Liability

To the maximum extent permitted by applicable law, PingNG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Account Termination

  • You may delete your account at any time from Settings. A 30-day grace period applies.
  • We may suspend or terminate accounts that violate these Terms.
  • Upon termination, your data will be permanently deleted per our Privacy Policy.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of France and the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of France.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
